1. Introduction

These Terms and Conditions (“Terms”) govern the use of the Esports Highschool League (“ESHSL” or “League”) platform and services. By using the ESHSL platform and services, you agree to be bound by these Terms. If you do not agree to these Terms, you are not authorized to use the ESHSL platform and services.

2. Definitions

  • “Platform” refers to the ESHSL website, software, and any other related technology used to host and operate the League.
  • “Services” refers to the various features, services, and functions available through the Platform, including but not limited to tournament play, player registration, and leaderboards.
  • “User” refers to any individual or entity using the Platform and/or Services.

3. Use of Platform and Services

  • The ESHSL platform and services are intended for use by individuals who are at least 18 years of age or older.
  • You agree to use the Platform and Services in accordance with all applicable laws, rules, and regulations, including but not limited to laws and regulations governing intellectual property, privacy, and data protection.
  • You agree not to engage in any activity that may be harmful to the Platform or Services, including but not limited to hacking, spamming, or distribution of malware.
  • You agree not to use the Platform or Services for any illegal or unauthorized purpose.

4. User Content

  • You may submit content, including but not limited to text, images, videos, and audio (“User Content”), to the Platform and Services.
  • You grant ESHSL a perpetual, non-exclusive, royalty-free, sub-licensable, and transferable license to use, modify, reproduce, distribute, and display your User Content on the Platform and Services.
  • You represent and warrant that you own all rights to your User Content or have obtained all necessary permissions to use and submit such User Content to the Platform and Services.
  • You agree to indemnify and hold ESHSL harmless from any claims arising from your User Content, including but not limited to claims of intellectual property infringement, defamation, and invasion of privacy.

5. Disclaimer of Warranties

  • The Platform and Services are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • ESHSL does not warrant that the Platform and Services will be uninterrupted or error-free, and ESHSL will not be liable for any disruptions or errors.

6. Limitation of Liability

  • ESHSL will not be liable for any damages, including but not limited to direct, indirect, incidental, special, and consequential damages, arising from the use of the Platform and Services.
  • ESHSL will not be liable for any damages resulting from the loss of data or User Content, or any other harm arising from the use of the Platform and Services.

7. Changes to Terms and Conditions

  • ESSHL reserves the right to modify these Terms at any time, without prior notice.
  • Your continued use of the Platform and Services following any changes to these Terms constitutes your acceptance of the revised Terms.

8. Governing Law

  • These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which the ESHSL platform is hosted.
